This page, our app, and/or any other platforms that may exist are owned and operated by Guiaderodas and are provided for your information, evaluation, and personal use. Please carefully read the TERMS OF USE and PRIVACY POLICY (hereinafter collectively referred to as the “Terms”) before using it. By downloading, accessing, browsing, and/or using this page and/or app, you expressly agree to the Terms. If you do not agree with the Terms or our Privacy Policy, do not access our page or app and leave immediately. We ask that you review these Terms from time to time, which will be available on our website, as we reserve the right to amend them at any time without prior notice to users. Any changes to these Terms will apply immediately upon posting the revised Terms on our Page and in our App. If the changes to the Terms are unacceptable to you, you will no longer have access to our page, app, and/or other platforms.

USE OF PAGE AND APP CONTENT

By downloading our application and accessing our website, you become subject to these Terms as well as the terms and conditions set forth herein. We understand that minors under 18 (eighteen) years of age have obtained authorization from their legal guardian to use and/or access our application and our website. The submission of information by you through any of our channels, whether through our application and/or our website, expressly authorizes us to use such information in any way we deem appropriate, without any restrictions of time, territory, modality and/or support. Guiaderodas is also authorized to edit any comments it deems necessary. The use of this Page and/or our Application for any illegal purpose or purpose prohibited in these Terms, as well as any purpose that goes against morality, good faith, the law and public order, is expressly prohibited. All content presented on our website is the exclusive property of Guiaderodas, including but not limited to texts, images, videos and other content displayed there, except for those expressly mentioned as being authored by another person, whether physical or legal. Therefore, the use, download, reproduction, storage, or distribution of any content available on this Page is expressly prohibited. Please refer to the clause below regarding Intellectual Property for more details on this subject. All content submitted or produced by you will remain your property, and you will retain all copyright and intellectual property rights to the material produced. Whenever used by Guiaderodas, your authorship will be cited whenever possible.

Terms of Use

  1. By using our website and/or our application, you declare that you are subject to the terms and conditions of these Terms.
  2. Using one of our channels makes these Terms valid immediately, taking effect from the start of its use.
  3. The use of our website and/or our application must occur in a way that does not disrupt, impair, disable, overload, or stop the website and/or the application, including, but not limited to, through loading, “flooding,” “mail bombardment,” or “stopping” the Site or circumventing our security.
  4. You will not attempt to gain unauthorized access to the website and/or the application through hacking, password minimization, or any other illegal means.
  5. You may not use parts of the website and/or the application within a website without our express written authorization.
  6. Guiaderodas reserves the right, at its sole discretion, to terminate and/or suspend your access to the website, the app and other platforms, or any part thereof, at any time, for any reason or no reason, without the need to notify you.

Your contributions on our channels

  1. Any and all contributions from you must be made legally and in accordance with good morals and public order.
  2. No contribution should be made in an abusive, offensive, and/or copyright-violating manner.
  3. The submission of any contribution from you to Guiaderodas, including, but not limited to, texts, images, videos, files, etc., may be used by Guiaderodas in any way it deems appropriate.
  4. You hereby authorize such use free of charge and non-exclusively, whether for publication, reproduction, transmission, retransmission, translation into other languages, inclusion in other works, representation, use by broadcasting, and other means of communication, through the use of existing technologies and/or those that may emerge in the future, also authorizing its use on other Guiaderodas platforms, in any territory and without time limit.
  5. If you do not agree with such uses, you should not submit any material to Guiaderodas channels.
  6. We inform you that other Guiaderodas users will be able to view and comment on your contributions, since the application is based on the exchange of information between users.
  7. Therefore, through this document you become aware that what is made available and/or included by other contributors refers to the opinion of third parties and not of Guiaderodas.
  8. Guiaderodas prohibits any type of sending of advertising, propaganda or promotional material, as well as chain letters and/or the sending of similar information. In addition, you are hereby informed that you should not disclose any personal information to any other user, nor should you use inappropriate, vulgar or offensive language in your comments and contributions.
  9. If you are under 18 years of age, we understand that your access is only granted with the approval of your legal guardian. Therefore, Guiaderodas informs you that there may be content restricted to minors under 18 years of age, and your participation must occur if you are over 18 years of age or, if under 18, with the authorization of a legal guardian.

Intellectual Property

  1. The content of the Guiaderodas website and/or app, and any other platforms that may exist, are the property of Guiaderodas, with the exception of the information found in our app about the locations described therein, which belongs exclusively to FourSquare.
  2. Except for your personal and non-commercial use, you are prohibited from reproducing, transmitting, distributing, publishing, or disclosing these materials, in whole or in part, without the prior consent of Guiaderodas.
  3. The word “content” includes, for example, any text, images, drawings, color combinations, audio and/or video files, logos, domain names, software, buttons, trademarks, slogans and designs, source code, interface, and the structure, design, selection, and arrangement or presentation of any information contained on this Page.
  4. Any unauthorized attempt to modify or use any Guiaderodas property or to circumvent or bypass our security settings, or to use our platforms or any part of the content or materials on them for any purpose other than that for which it is intended is strictly prohibited.
  5. The use of any of these materials or content is entirely at your own risk. Guiaderodas reserves the right to change any and all content, materials, software, applications, and other items used or contained on our platforms at any time without notice.
  6. Guiaderodas will not be held liable in any case for any infringement of intellectual property rights caused by third-party content. Additionally, Guiaderodas will not be liable for any damage to persons or property due to methods, theories, ideas, opinions, statements, or recommendations of third-party users expressed in its application.

Failure to comply with the Terms

  1. Any use of Guiaderodas platforms (website, app, or others that may be created) in a manner contrary to the provisions of these Terms will result in the termination of your participation and a ban on the future use of your name.
  2. However, your personal data will remain recorded and archived for Guiaderodas’ future use—if necessary—in the event that the company is notified and/or legally challenged by specific authorities regarding the infringement of third-party rights.
  3. If you discover that any work(s) owned by you have been used inappropriately by another user on any of our platforms in a way that constitutes an infringement of your rights, we ask that you send Guiaderodas a description of the situation, along with your personal details, so that we may take the necessary measures.
  4. You agree that upon receipt of such a communication, Guiaderodas may immediately remove the content in question without prior verification, while reserving the right to republish said content should it be demonstrated that the complaint is unfounded.

General Conditions

  1. Guiaderodas is not responsible for the content or policies of third-party pages, and you understand and agree that your access to such pages is at your own risk.
  2. You acknowledge and agree that we shall not be liable for any losses or damages (whether direct or indirect damages, lost profits, liquidated damages, or fines) arising from or in any way related to your access to or use of any third-party page.
  3. Guiaderodas does not offer or sell—directly, indirectly, or through third parties—the products and services available on third-party pages. Guiaderodas advises that it does not control, monitor, or endorse products, services, content, information, data files, or any type of material found on third-party pages.
  4. Accordingly, Guiaderodas recommends that users exercise extreme caution when evaluating and using services, information, data, files, products, and any type of material on such third-party sites.
  5. The webpage and/or application may contain typographical errors and/or other types of errors, and you agree that we shall not be held liable for such errors. Guiaderodas does not represent or warrant that this page will be error-free, that access to it will be uninterrupted, or that the site or the server making it available is free of viruses or other harmful components.
  6. Guiaderodas expressly states that it may alter the page materials at any time without prior notice.
  7. Use of the page is at your own risk, and you assume full responsibility for any costs associated with using this page, provided the cause is not attributable to Guiaderodas.
  8. Our failure to exercise, in whole or in part, any rights, or our waiver regarding any breach of these Terms on your part, does not prevent the subsequent exercise of such right, nor shall it be considered a waiver on our part regarding any subsequent breach by you of the same or other conditions of these Terms.
  9. Our rights and remedies under these Terms shall be cumulative, and the exercise of any such right or remedy shall not limit our right to exercise any other right or remedy. If any provision of these Terms is held to be invalid or unenforceable under any law, regulation, or order, such provision shall be deemed modified or excluded only to the extent necessary to comply with such requirement, and the remaining provisions of these Terms shall remain in full force and effect.
  10. These Terms shall be governed by and construed in accordance with Brazilian law.
